can my employer use my picture from my facebook page to ask people to identify me during a disciplinary investigation.?

    If you've already set your picture to public, then the answer is yes.

    They can so long as it is a public picture. However, if they obtained the photo by virtue of impersonating another to get access to your friend's list, then that becomes illegal- both under false personation laws (it is illegal under federal law to impersonate another or provide a fraudulent identity on the internet with the intent to cause someone to act a certain way.) as well as computer trespass laws.

    I thought most companies took a picture of their new hires and kept it with their employee file. Seems a small matter to be worried about. Should be worried about all of the pics where you're doing something stupid.

    My guess is they didn't take it form your facebook page.

    They googled your name, looked at the images of you that popped up and selected one they wanted to use.

    If you don't like it, tell google to stop skimming your facebook profile.
