    Originally, years ago, Short Message Service (SMS) provide the capability for texting. Typed on a phone, press send, the text message was sent to a server at the cell phone service provider's switching center. From their, by locating the text message's destination phone number, the cell phone provider's subscriber information would locate the recipient - then send the message.

    This still happens a lot... BUT... text, alone, got boring. In order to have an improved messaging experience, MMS (Multimedia Messaging Service) and finally (now), RCS (Rich Communications Service) happened. One can text, send video, still images... all sorts of stuff. As I understand it, neither MMS nor RCS are included in the proposal to "tax texting". Only SMS.

    Companies like Google and Apple developed more robust written communications system - similar to texting but using servers maintained by them (not the cell phone service provider) are used. iMessage, Messages and other MMS and RCS apps have essentially replaced SMS - but there is still SMS so the different MMS and RCS apps can talk to each other. Along with this, many of the Internet of Things devices will communicate with each other using SMS and SMS-like communications.

    For example, if your oven needs to send a message to your smartphone to tell you that whatever was cooking is done or the timer just hit 0 or whatever, that communication will probably be with a SMS text message.

    2) Which Government entity is responsible for oversight of interstate communications systems?
    Not State government... it is the Federal Communications Commission (FCC) that has that jurisdiction.

    So... We use an "over the top" service that is MMS or RCS, not SMS... and the boneheads who came up with this idea (including the "retroactive for 5 years") can fall off the face of the earth and donate their entire salary and net worth for the next few generations of their families to fund the programs this "texting tax" was to fund.

Check what other apps are already-running after you ffeshly power on the phone (after a full power off). Maybe you will see some camera-using app already running, and if you don't really need that app, try uninstalling that. (Don't uninstall your original camera app).

As long as yo have a Nevada billing address, which if I'm not mistaken, you would need to get the Nevada cell number, at least from a Nevada carrier. You can buy a phone from anywhere, cash, but plan that need contracts for certain billing... show more

You can buy a phone from anywhere, cash, but plan that need contracts for certain billing plans or contract for paying off a phone in installments, would need the billing address to be for the carrier in the state you are buying said plan.

    Pretty sure there are work around cheats, like having a mail drop in the state of Nevada as your billing address. Or having a friend that lives in Nevada allow you to use their address as your cell phone billing address, but is the effort of doing that worth it to you, just to have a Nevada phone number to skip out on cell phone taxes in California?
