    I am 7 months pregnant. I just moved into an apartment now, a little over 2 weeks ago. I didn’t get a chance to view the apartment because I felt I was at a dead end; I had no where else to go. My aunt gave me until the end of March (March 30) to leave, regardless. My local family homes where all booked up. So I signed a lease to stay in this apartment. However, when I got there, the apartment was not clean, not even a little. There are no locks on the windows, there’s water damage in the bathroom, wood chippings about 1/3 up the wall, there are small holes here and there, the doors are peeling, some parts of the walls is like someone may have punched them. Note: Maintenance painted over all of this. There’s a lot of floor damage, there is a big gas heater sitting in my living room, and there was black stuff in my air conditioner. The place smell of stale air, like it’s old. I used to hear noises when I moved in. I pray every night nothing happens. I feel as if this place is not secure enough nor sanitary enough for me or my soon to be newborn. I would like to get out of my lease immediately.

Problem is they partying every single. Numerous complaints have been made from others in the building and even other next door neighbors. We have told them to be quiet at 10pm. It might work for one day. Then they party again. I don’t know if they just don’t care or if they know understand social norms in the USA. I’ve noticedthey will talk very loudly on their balcony without any regard for the people around. Yelling , screaming and laughing. At all hours of the day. Neighbors have come to me to complain. Asking me what’s going on. The apartment manager has even spoken to them and it hasn’t improved. Nobody else in the neighborhood acts like this. Only the foreigners. Notice that? Everyone else knows how to behave and has common curtesy for the people around them. I’m guessing that things are much different in Brazil

    But this doesn't happen overnight. There is no executor because there is no will. The state approves an administrator. Again, this does not happen overnight. I need to know:

    Was someone living in the house, besides your grandmother, at the time she died? If not, did your mother move in immediately? Did your grandmother die much more than the four months ago? Because if she did, either someone made some payments - who was that? Or the mortgage is more than four months behind. Did anyone ever apply to be appointed administrator?

    It's possible that no one did. Maybe your mother just took it upon herself to move in and start living there for free, without the property going through probate. The bank couldn't care less about that, they can go forward with foreclosure.

    You need to talk with an attorney to see if they can find out if any paperwork was ever filed. If not, your mother acted illegally. It may be too late to save the house, but it also may not. You may be able to be appointed administrator, and with the help of an attorney, extricate your mother from the picture and have control over what happens to the house. You can pay what you need to pay to bring the mortgage current and try to get that back somehow in the purchase of the house from the estate. This assumes that your grandmother left no additional debt that could only be paid off with money from the house. If there is other debt, the house will probably be lost no matter what you do.

    So look for an attorney well-versed in intestacy law and start looking tomorrow.

I am a real estate broker and put an offer sight unseen in on a small house last year. Since it was such a frantic market for inexpensive houses, I was comfortable looking at the pictures and knowing the neighborhood, and it was actually nicer than the photos showed, so I'm very happy with my purchase. I've also represented several buyers in a similar situation, a couple of times in an investment property where they didn't want to bother tenants until there was an actual buyer, and a couple of times where the buyer was out of town and relied on me to look at it for them.
