Do I have a good chance of appealing my p1 license?
I currently hold my P1 license and over the easter holidays i was booked for exceeding the speed limit. I was doing 105km p/h in an 80km p/h zone and lost 8 points. This is my first ever offence and the undercover cop was following me for 35 minutes and as i picked up some speed on the bottom on a hill, thats when he booked me. I am dependent on my license to get to and from school and to tafe a nights and my tafe course runs through my school so If i can't go to tafe i will not be elagble to receive my HSC. I know it was wrong of me to be speeding but it's my first offence and I need my lisence! Everyone else were exceeding the speed limit as i was driving with the flow of the traffic but i got booked. I think this is unfair so please help! is there a good chance i can appeal this?!
"But I REALLY need my license!" If that was a reason for the court to leave your license valid ... no one would ever have a suspended license. We all need our licenses to get places ... smart drivers don't do things that lead to suspension of driving privileges.
"Everyone else was speeding! I was just following them!" To paraphrase my mother "If everyone else jumped off a cliff would you follow?"
"Everyone was doing it, but I'm the only one that got caught, NO FAIR!" Did you ever go fishing? Did you ever catch ALL the fish?
"I picked up speed going down hill" Speed limits apply on all public roads ... up hill, flat and downhill.
Chance of successful appeal ... not good. The case against you is strong.
The government is very strict on P-plated drivers. They want you to learn your lesson and i highly doubt you would be able to get away with this. You could go to Court and ask for an appeal but most likely they will suspend your licence for a period of time. The best they can do is decrease the suspension period. Good luck
